This Privacy Policy is provided by the Owner or Management Company, Peak Living, and applies to all rental applicants and residents in Texas. It outlines Peak Living's policy regarding the collection, use, protection, access, and disposal of personal information, in accordance with applicable federal and state laws.

 

  1. Collection of Personal Information

Resident acknowledges and agrees that, in connection with the application for tenancy and during the term of the Lease, Owner or Management may collect certain personal identifying information. Such information includes, but is not limited to, the Resident's full legal name, address, telephone number, email address, date of birth, Social Security Number, driver's license or state-issued identification number, employment and income information, rental history, emergency contact information, and financial or banking details provided for payment purposes.

  1. Method of Collection

Personal information is collected through written and electronic rental applications, lease documents, correspondence with the Resident, information submitted via online resident portals, and other written or verbal communications between Resident and Owner or Management. In some cases, information may also be obtained through third-party services such as apartment locator services, credit reporting agencies, or other third-party tenant screening companies like Yardi ScreeningWorks authorized by the Resident.

  1. Use of Personal Information

Owner or Management shall use personal information solely for legitimate business purposes related to leasing and management of the Property. Such purposes include, but are not limited to, verifying identity and application details, conducting background, credit, and rental history checks, processing lease renewals or modifications, enforcing lease obligations, communicating with the Resident regarding tenancy, and complying with applicable legal requirements.

Owner or Management shall restrict access to personal information to authorized personnel only. All personal data, whether in paper or electronic format, shall be stored in secure areas and systems.

Reasonable measures shall be taken to protect against file cabinets, password-protected databases, and secure network environments.

Access to Resident's personal information shall be limited to management personnel, employees, or agents who require such access in the performance of their duties. Personal information may also be shared with third-party service providers engaged in business operations on behalf of the Owner or Management, provided such third parties are bound by confidentiality and data protection obligations.

6. Disposal of Personal Information

When personal information is no longer required to be retained under applicable law or for business purposes, Owner or Management shall ensure the secure disposal of such information. Disposal methods shall include, without limitation, the shredding of paper documents and the permanent deletion or destruction of electronic records to prevent unauthorized recovery or access.

7. Resident Rights

Resident may submit a written request to access, correct, or delete personal information held by the Owner or Management. Such requests may be submitted via email to [email protected] or by mail to C/O Peak Cares, 2054 W Grove PKWY, Pleasant Grove, UT 84062.

s. Locator Services

If a locator service was used to find the Property, Resident acknowledges that such locator service operates as an independent contractor and is not affiliated with the Owner or Management. Resident should obtain a copy of the locator's privacy policy independently.

9. Entire Agreement

This Addendum constitutes the entire agreement between the parties with respect to the subject matter herein and shall be binding upon the Resident and Owner or Management. In the event of any conflict between this Addendum and any other provision of the Lease, the terms of this Addendum shall govern as to matters of privacy and personal information.
